Always an Adventure Travel Terms & Conditions

Effective Date: May 5, 2025

Thank you for choosing Always an Adventure Travel. By requesting a quote, making a reservation, submitting payment, signing a travel agreement, or otherwise utilizing our services, you acknowledge that you have read, understand, and agree to these Terms & Conditions.

1. Agency Relationship

Always an Adventure Travel acts solely as a retail travel advisor and agent for independent travel suppliers, including airlines, cruise lines, hotels, resorts, tour operators, transportation providers, and other travel vendors.

We do not own, operate, manage, or control these suppliers and are not responsible for their acts, omissions, financial default, service failures, schedule changes, or operational decisions.

2. Reservations & Pricing

All reservations are subject to availability and supplier confirmation.

Pricing is not guaranteed until payment is received and confirmed by the supplier.

Supplier promotions, discounts, and special offers may be modified or withdrawn without notice.

Changes to names, dates, passenger information, or travel arrangements may result in supplier-imposed fees, fare increases, or penalties.

3. Payments

Payment schedules are established by the travel supplier and will be provided in your booking confirmation.

Failure to make payments by the supplier’s deadlines may result in cancellation and applicable penalties.

Any planning, research, consultation, or service fees charged by Always an Adventure Travel will be disclosed in advance and are non-refundable.

4. Cancellations & Refunds

All cancellation requests must be submitted in writing.

Refunds and cancellation penalties are determined solely by the supplier and may vary by reservation.

Always an Adventure Travel is not responsible for refund amounts not issued by a supplier.

5. Travel Protection

Travel insurance is strongly recommended.

Travelers declining travel protection assume full financial responsibility for cancellation penalties, interruptions, delays, medical emergencies, weather events, supplier insolvency, and other unforeseen circumstances.

6. Travel Documents & Requirements

Travelers are responsible for obtaining and carrying all required travel documents, including passports, visas, vaccination records, and destination-specific entry requirements.

Travelers must review all confirmations, invoices, tickets, itineraries, and travel documents upon receipt and notify Always an Adventure Travel of any discrepancies within 24 hours.

Failure to report errors promptly may result in additional costs or supplier-imposed penalties.

7. Independent Airfare

If airfare is purchased independently, travelers are responsible for providing complete flight details no later than three weeks prior to departure if airport transfers have been arranged through Always an Adventure Travel.

8. Force Majeure

Always an Adventure Travel shall not be liable for delays, cancellations, losses, additional expenses, or disruptions caused by circumstances beyond our control, including but not limited to weather events, natural disasters, pandemics, communicable diseases, government actions, labor disputes, transportation interruptions, or acts of God.

9. Assumption of Risk

Travel involves inherent risks including illness, injury, accidents, transportation delays, supplier failures, weather disruptions, political instability, and other unforeseen circumstances.

By participating in travel arrangements, travelers voluntarily assume all known and unknown risks associated with travel.

10. Limitation of Liability

To the fullest extent permitted by law, Always an Adventure Travel’s liability shall be limited to the amount paid directly to the agency for services rendered.

11. Chargebacks

Travelers agree to make a good-faith effort to resolve concerns directly with Always an Adventure Travel and/or the travel supplier before initiating a chargeback or payment dispute.

Non-refundable deposits, planning fees, supplier cancellation penalties, and agreed-upon supplier terms do not constitute valid grounds for a chargeback.

12. Governing Law

These Terms & Conditions shall be governed by the laws of the State of New Jersey.

Any dispute arising from services provided by Always an Adventure Travel shall be resolved exclusively in a court of competent jurisdiction located within the State of New Jersey.

13. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
